Apshan is a French company. This page is provided in English for convenience. The French version of this policy is the legally binding text.

1. About this policy

This Acceptable Use Policy ("AUP") sets out how the Apshan service may not be used. It is incorporated into the Terms of Service by reference; violation of this AUP is a breach of the Terms.

The rules below apply regardless of the access path: the Apshan website, the dashboard, Apshan Tools, or any documented API.

2. Scope

This AUP applies to every Customer, every authorized user under a Customer's account, and every visitor that interacts with the Service. Capitalized terms have the meaning given in the Terms of Service.

3. Prohibited content

You may not use the Service to upload, generate, transmit, or facilitate:

  • content depicting or facilitating the sexual exploitation or abuse of minors;
  • content that incites, threatens, or glorifies violence against individuals or groups;
  • content that harasses, intimidates, defames, or doxxes a person, or that violates their privacy;
  • content that promotes discrimination on protected grounds;
  • content that infringes the intellectual property or moral rights of a third party;
  • spam, deceptive solicitation, or unsolicited bulk communications;
  • content prohibited by applicable law in any jurisdiction in which you operate.

4. Prohibited technical behavior

You may not:

  • attempt to gain unauthorized access to the Service, other users' accounts, or any connected system;
  • introduce malware, viruses, ransomware, or other malicious code;
  • launch denial-of-service attacks, conduct port scanning or vulnerability probing outside of Apshan's responsible disclosure policy;
  • evade rate limits, multi-tenancy boundaries, or other technical access controls, including by automating account creation or trial cycling;
  • systematically scrape, crawl, or harvest content from the Service except as expressly permitted by the documented APIs;
  • interfere with the integrity or performance of the Service or with another user's experience.

If you discover a security vulnerability, report it to security@apshan.com. Good-faith security research that follows our responsible disclosure expectations will not be treated as a violation of this AUP.

5. Prohibited AI use

You may not use the Service, including any generative output from Florye or other Apshan capabilities, to:

  • create non-consensual intimate imagery, sexual content involving real persons without their consent, or any sexualized content involving minors;
  • impersonate a real person, brand, or organization in a way likely to deceive, including synthetic voice, image, or video designed to be passed off as authentic;
  • generate or amplify election-related disinformation, misleading political advertising, or content designed to manipulate democratic processes;
  • produce content that defames a person or organization or that contains false and injurious statements presented as fact;
  • strip provenance signals (C2PA metadata, watermarks, source citations) from outputs in order to misrepresent their origin.

6. EU AI Act prohibited practices

The Service may not be used for any practice prohibited under Article 5 of the EU AI Act (Regulation (EU) 2024/1689), including:

  • subliminal, manipulative, or deceptive techniques designed to materially distort behavior in ways that cause significant harm;
  • exploitation of vulnerabilities of specific groups (age, disability, social condition);
  • social scoring of natural persons leading to detrimental or unfavorable treatment;
  • real-time remote biometric identification in publicly accessible spaces, except where expressly permitted and lawfully authorized;
  • biometric categorization of natural persons by sensitive attributes such as race, political opinions, religious beliefs, or sexual orientation;
  • predictive policing of individuals based solely on profiling.

This list is non-exhaustive. The full text of Article 5 governs in case of any inconsistency.

7. Service integrity

You may not:

  • connect to the Service through an AI client that Apshan does not officially support, or misrepresent the connecting client's identity in any way that circumvents that restriction;
  • systematically extract or attempt to reconstruct Apshan's knowledge graph, embeddings, trained models, source-relationship maps, or proprietary methodology;
  • use outputs of the Service as training data, fine-tuning data, retrieval-augmented generation corpora, or evaluation data for any AI model that competes with Apshan;
  • redistribute, resell, or republish Apshan outputs without preserving the source citations attached to them;
  • represent Apshan outputs as authoritative without disclosing that they are AI-generated, where required by law or industry custom.

8. Compliance with applicable law

You are responsible for using the Service in compliance with all laws applicable to you, including export control, sanctions, data protection, and sector-specific regulation. You may not use the Service from, in, or for the benefit of, any jurisdiction or person subject to comprehensive sanctions administered by the EU, France, the United Nations, or other competent authorities binding on Apshan.

9. Enforcement

Apshan may, at its discretion and depending on the severity of the violation:

  • warn the responsible Customer or user;
  • require remediation within a reasonable cure period;
  • suspend access to the Service for the affected user or account;
  • terminate the Customer's Subscription;
  • preserve and disclose data to law enforcement where required by law.

For serious violations (particularly those listed in Sections 3 (illegal content), 5 (AI misuse against persons), or 6 (EU AI Act prohibited practices)), Apshan may suspend access without prior notice.

Apshan reserves the right to pursue all available civil and criminal legal remedies against any person who breaches this AUP. For violations involving illegal content, technical attacks against the Service, EU AI Act prohibited practices, or unauthorized extraction or reconstruction of Apshan's proprietary systems, Apshan may pursue legal action without prior notice, preserve evidence, and cooperate with law enforcement and other competent authorities.

10. Reporting violations

If you become aware of conduct that violates this AUP (your own, another user's, or a third party's misuse of Apshan content), report it to legal@apshan.com. Include enough detail for us to investigate (URLs, timestamps, account identifiers, screenshots where applicable). We acknowledge reports without undue delay.

11. Changes to this policy

Apshan may update this AUP as misuse patterns evolve. Material changes will be announced by email and surfaced in-product before they take effect. The "Last reviewed" date at the top of the page reflects the most recent change.
